As of 2018, it became legal to use and cultivate hemp derived cannabinoids and hemp. However, whether to reject that bill or adopt it is still up to individual states. HB 523 – House Bill 523 – in September 2019, passed into Ohio law. This law allows, among qualified patients, the use of medical marijuana. There is, of course, a fairly long list of qualifying conditions. Compared to some other states, it’s not particularly easy to get a medical marijuana card in Ohio.
Now, it’s a whole other ball game where CBD products and hemp derived CBD oil are concerned for Ohio. Currently, Ohioans can purchase and use hemp derived CBD legally.
Ohio Laws Regarding CBD
Before HB 523, some individuals thought that the 2018 Farm Bill okayed the sale and use of CBD oil. That was, however, not truly the case. Because of previously strict regulations, many stores were forced to stop selling CBD products. Of course, that didn’t stop people from purchasing CBD online, whether or not it was actually legal in their state. These people were able, before purchasing their product, to research the brand, read brand reviews, and view third-party lab results before ordering online.
The legalization for the sale and use of CBD oil in Ohio didn’t happen until relatively recently and you’re bound to find those that still don’t agree with the ruling. The fact remains, however, that as long as the THC dry weight level in the CBD product is less than 0.3%, you’re in the clear. Farm groups have applauded Gov. DeWine’s bill legalizing hemp cultivation in Ohio, as well.
Specific Ohio Guidelines For Selling/Growing CBD Oil
Though CBD is legal in Ohio, there are stipulations in place:
- You can’t grow hemp if, within the last 10 years, you have a felony related to controlled substances.
- In Ohio, hemp is still a regulated crop, so a license from the State Department of Agriculture is required for all hemp farmers.
- All Ohio hemp farms must be tracked by the state.
- In order to comply with state law, (once again) less than 0.3% THC must be contained within CBD products.
- Less than 0.3 THC must be contained in hemp grown in Ohio.
